The Respect State Housing Laws Act (H.1078) has been reintroduced in the 119th Congress to end the CARES Act’s 30-day notice requirement to pay or vacate for covered properties.
It has been referred to the House Financial Services Committee. Again introduced by Representative Barry Loudermilk (R-GA), this bill has 17 co-sponsors, consisting of 16 Republicans and 1 Democrat. The lone Democrat co-sponsor is a name known to many NAA members. Representative Vicente Gonzalez, Jr., received NAA Independent Expenditure funds to assist with his re-election campaign last fall.
Additionally, S.470 is introduced as a companion bill in the Senate to amend the CARES Act, eliminating the requirement for covered lessors to provide a 30-day notice to vacate. This bill was introduced by Senators Cindy Hyde-Smith (R-MS.) and Bill Hagerty (R-TN.). It has been referred to the Senate Banking, Housing, and Urban Affairs Committee.
Co-sponsorship of these pieces of legislation will be an ask at The Advocate Conference, which allows members to meet with their congressional representatives in their Washington, DC, offices.
“Unnecessary and duplicative federal intrusion into complex state and local law amplifies the financial and operational challenges housing providers across our country continue to face. With 93 cents of each rent dollar paying the bills that keep rental housing operational, prolonged disturbances to standard operating procedures have major implications,” said National Apartment Association President and CEO Robert Pinnegar.
“On behalf of the nation’s rental housing providers, the National Apartment Association thanks Representatives Vicente Gonzalez and Barry Loudermilk and Senators Bill Hagerty and Cindy Hyde-Smith for recognizing this adverse impact and reintroducing the Respect State Housing Laws Act to help restore balance and normalcy to rental housing operations.”
